The news

New Delhi. Union Health Secretary Punya Salila Srivastava has written to the Chief Secretaries of all States and UTs to review compliance and ensure that hospitals and clinics prominently display their rates for services and facilities, per a PIB release of 12 October. Under the Clinical Establishments Act, 2010 and its 2012 Central Rules, covered establishments must display the rates for each type of service “at a conspicuous place, in the local language as well as in English”. Where the Act does not apply, State laws govern, and the letter notes that “health is a State subject”, so enforcement rests with States. New this time: hospitals are asked to display package rates for foreign patients on medical or Ayush visas. The device makers’ body AiMeD wants margins traced across the supply chain (The Economic Times).

Prelims nuggets

  • Health — “public health and sanitation; hospitals and dispensaries” — is entry 6 of the State List, so the Clinical Establishments Act, 2010 was passed under Article 252(1) and applies only in UTs, the four States that sought it (Arunachal Pradesh, Himachal Pradesh, Mizoram, Sikkim) and States that adopt it by resolution.
  • Rule 9 of the Clinical Establishments (Central Government) Rules, 2012 requires display of rates in clause (i) and charging within a Centre-notified range of rates in clause (ii).
